Robert O'Keefe | Mediator & IP Attorney
Mediation
Robert is an active listener, engages the parties on the particulars of their cases, finds common ground for the parties, facilitates discussions between the parties, and works to increase the parties' knowledge to provide an improved basis for settlement.

Robert conducts mediations both in-person and virtually. His services include half-day, full-day, and multi-day mediations.
Mediation affords parties certainty and control over the outcome of a dispute, as contrasted with an unpredictable court ruling.
In IP litigation, confidentiality surrounding confidential information, trade secrets, and manufacturing processes is paramount. Mediation offers a platform where parties can safeguard sensitive information while exploring creative and intricate resolutions that often surpass traditional litigation boundaries.
Furthermore, mediation presents a cost-effective and efficient avenue for overcoming hurdles and achieving settlements that might otherwise prove elusive. Its flexibility and focus on resolution enable parties to navigate complexities, fostering agreements that align with their unique needs.
Approach to Mediation
Robert begins with preparation, reviewing materials from each party prior to the session so as to become familiar with the overall dispute. He prefers to have informal discussions with each party prior to a mediation and uses all this information to determine what would work best for the particular dispute at issue. During a session, Robert provides careful consideration of facts and positions. He strives to increase each party's knowledge to advance toward a reasoned basis for settlement. He proactively follows up with both parties after a session if, for example, more work was needed by the parties.
